Sells Unsafe Vehicles
Written by Erica on 05/01/2019
We purchased a vehicle from Tim Dahle Nissan in West Jordan. Upon receipt of the vehicle there were check engine lights on the dashboard. The following lights were on the dashboard. The brake sensors stating that there was a failure in the braking system and that the pads were needing to be replaced. There was a battery light on indicating that the battery was bad. There was also a steering warning light on and the system advising that increased steering was going to be necessary for the vehicle. When the vehicle first arrived off the truck it was stiff to steer. We did not receive any safety inspection reports on the vehicle when the vehicle arrived from the dealership showing one was done 24-48 hours prior to being loaded for transport. We also did not receive any written or verbal disclosures of issues with the vehicle prior to the closing of the sale. When the vehicle had just come off the truck on the 15th we immediately took it for additional inspections to ensure the vehicle was safe to drive. We were unable to drive the vehicle legally due to the dealership not providing the title and then sending out a temporary registration for the vehicle. We were not able to drive the vehicle until 4/16/19. Within 24 - 48 hours of being able to legally drive on the roads, the vehicles steering became increasingly difficult to the point where the vehicle's steering system completely stopped working on the morning of 4/18/19. My son, who is 17 years old was driving the vehicle when this occurred on his way to work. He came close to having an accident as a result of the steering going out while he was driving. I attempted to drive the vehicle in a parking lot so I could understand the steering issue. I was unable to safely steer this vehicle in any manner. We took it to the auto repair shop next door to his work who could quickly inspect the vehicle and run diagnostics on the steering. It was then concluded that the vehicles steering system had failed and we then had to tow the vehicle to the nearest BMW dealership as the vehicle had multiple failures that the shop felt needed to be addressed by BMW to ensure that the vehicle is restored to a safe driving condition. The vehicle sat at the BMW dealership for nearly a week between diagnostics, ordering parts for repair and repairing the vehicle. The following was concluded that was present prior to the vehicle being delivered to us in Colorado. Serpentine belt was cracked and required replacement; it was stated that this should have been noted on a recent safety inspection report. The vehicles steering system EPS wiring harness that goes to the system was damaged, the clips were broken and was causing the harness to not stay in place and is what led to the ultimate failure of the steering system. The battery was found to be faulty and had low voltage which as a result it was storing the faulty codes for the steering system each time it was sending a warning regarding the steering. Upon taking the vehicle to BMW the reports came back regarding the steering system, braking system, as well as additional issues with the vehicle, and the electrical system of the vehicle. We were trying to give the dealership benefit of the doubt on the battery and omitted the cost for the battery. The total cost for the repairs to make the vehicle safe were $566.05. I spoke with Marco again on 4/30/19 - He stated the dealership knowingly sells unsafe cars and does not repair them prior to selling. They have no intention on reimbursing for the car to be made safe and pass safety inspections for registration. 4/30/19 I spoke with Marco again he knowingly stated they sell vehicles that are unsafe and they do not repair the vehicles prior to selling. They are refusing to cover the repairs made to the vehicle to make it safe and to pass safety inspections.
