I agree that driving offenses don't merit a jury trial. That's not the point I was making. The fundamental difference here is not the level of severity but who the burden of proof falls on. For a serious offense the state has to prove its case. For a traffic offense the alleged violator has to prove his innocence. That's impossible to do. I doubt there is anything in common law regarding this shift in the burden of proof based on the severity of the offense. My last ticket was in Bluffton, SC. There is a notorious speed trap where the limit goes from 55 to 45 then almost immediately to 25 for about 200 yards then back to 45. I wasn't familiar with the area at the time but it turns out there is always a cop there. It really is like shooting fish in a barrel. I was pissed enough to show up in court for this one. There must have been a dozen people before me that all had received speeding tickets in the exact same spot. Most of them were going 15-25 mph over the limit. When they got in front of the judge he offered them the chance to plead guilty to 9 mph over the limit. Of course there was an additional fee involved. I was only clocked at 11 mph over the limit, the slowest of anyone there. When it was my turn before the judge I wasn't offered the same deal and was found guilty for 11 mph over the limit, which carried more points. I asked the judge why I didn't get the same offer. His response was that the previous cases have no bearing on my case. It does turn out that I was the only one with an out of state drivers license.

Stations selling E85 below cost By Dan McFeely dan.mcfeely@indystar.com It’s costing a little bit more for patriotic E85 drivers to stick it to foreign oil suppliers these days. Ethanol-blended fuel - made from Midwestern corn and touted as one way to wean America off of foreign oil dependency - is selling almost 70 cents higher than it was just a few months ago. A check this morning with a few of the 32 Indiana gas stations that sell E85 shows the price hovering between about $2.70 to $2.80 a gallon. At Joe’s Junction on Kentucky Avenue on the Southside, the price was $2.84, compared to $2.09 in February – and compared to $2.86, the average for regular unleaded fuel. But even that higher price for ethanol is less than what station owners are paying, according to Kellie Walsh, executive director of the Central Indiana Clean Cities Alliance, which promotes alternative fuels. Rack prices – the industry term for the price a station pays to a fuel supplier – for ethanol are about $3.36 in central Indiana, which includes fuel, taxes and transportation costs. “Some of these owners are really taking a hit in order to keep E85 on the market,” said Walsh. “They know that this time next year, production will be up and prices will come back down.” Ethanol price increases are being blamed on high demand from states that have phased out MTBE as an octane booster (which helps prevent engine knocking). Ethanol is used (at 10 percent) to boost octane and does not have the environmental health risks that are present in MTBE. Meanwhile, production and sale of E85 continues to climb. Indiana has five new ethanol plants under construction with two scheduled to open by this fall. Plans have also been announced for future ethanol plants in Hoosier towns such as Rushville, Bluffton, Marion and Rensselaer. South Bend-based New Energy Corp. is the only active plant in Indiana, churning out 100 million gallons per year. National retailers Wal Mart, Meijer and Kroger have each announced aggressive plans to add E85 pumps to their fueling stations in the Midwest and around the country. This week, the first E85 plant in oil boomtown Houston was opened at a Kroger store.Indiana has 32 E85 pumps, a number that is expected to climb this year. Meijer, for example, opened its first city pump in May and announced plans to have 20 pumps in operation by the end of the year.

Well, I finally got my truck back from the dealer. You were right Dusty, no problem with the converter just mainly the intake gasket. They replaced some other items also. They replaced one injector, some water hoses, my new plug wires that I posted earlier, the oxygen sensors etc. My truck seems to be running better than it was before I started having the trouble :D Thanks for the warranty info also but I'm at 164000 on the mileage so warranty's not an issue. The majority of the cost of the repair (1.6K) was the labor. Thanks to everyone who posted their thoughts and tried to help. Think I'll tow my boat to the river for a little R & R today :shades: Steve

Now the dealer is telling me that I need Oxygen sensors also. May have my truck back this evening if all goes well?

Well, here it is Monday and still no conclusive diagnostic, well, not completely anyway. I decided to take a trip to my dodge dealer to get some stuff out of my truck and talk with the mechanic. He said that the new plug wires that I just installed from NAPA were arching and causing a misfire (I admit, I opted for the cheap set :cry: ). I informed him that this was after the fact, an attempted repair. He also said that the intake gasket was leaking badly and needed to be replaced. I asked him how many codes he was able to pull off the computer? He replied-0. I asked if that seemed strange given the way the truck was running and backfiring. He admitted that it did seem strange and stated that I may also have a bad Oxygen sensor. I called them back today and asked them to thoroughly check the converter. I figure that the converter may have caused the back fire if it was partially blocked taking out the intake gasket and not displaying any codes if the sensors are indeed bad. The dealer said that I was already up to around $1100.00 without the converter :surprise: I'll keep you guys posted.

Sorry, all the info. about my 1997 Dakota with the 3.9L 6cyl was in earlier postings. I have no idea where the hose came from. I've looked at the manual and the routing decal. I'm thinking about taking my truck to a Dodge Dealer for diagnostics. I performed the test on my crankshaft positioning sensor which failed. A Mechanic that I spoke with said that the voltage during the test should always change from 0-5 volts. Mine would go 0-5, 0-1.5, 0-2, 0-5. He said that was not good. So $100.00 and a lot of work later my truck still runs like crap. It still idles really ruff after it warms up for about 15 minutes,it still has no power at times, and it still backfires up through the throttle body. The hose was just part of an ongoing post of problems. Thanks for responding though. :confuse
